52 Ancestors: #44 - William Pendleton HERNDON

Scamming old people is nothing new.  My 4X great-grandfather William Pendleton HERNDON was the victim of a scam at the hands of the very people who were supposed to represent his interests.

Until William Herndon applied for a pension for service to his country, he lived a rather ordinary life.  He was born in Albemarle County, Virginia in 1764, one of twelve children born to Edward and Mary Ann Gaines HERNDON

William was just sixteen when he joined the militia in Culpeper County in the war for independence from England.  He served three tours of three months each.  He saw action early.  Soon after enlisting, he found himself in the Battle of Petersburg under the leadership of Captain Ambrose Bohannon and General Peter Muhlenberg.  The militia was outnumbered 2 to1 but they put up a good fight giving General Lafayette time to entrench the Regulars in Richmond, thus saving the city from another assault.

The militia removed to Chesterfield Court House, and from there William returned home after his three-month obligation was complete.

The second time he was drafted, William spent much of his time near Richmond at Morbin Hills and Camp Holly where he was regularly in the company of Lafayette and Muhlenberg.  The conversations around the campfire must have been charged with emotion and patriotism, so inspiring for young boys like William.  He was only 16 and in the presence of the very leaders who would become our nation’s heroes.

His final tour was in Fredericksburg and Germanna.  In 1781 at age 17, he was discharged and returned to Culpeper County and to farming.

In 1785, he married Mary RUCKER, daughter of Thomas and Elizabeth Wisdom Rucker, and soon started on their own brood of twelve children.

Fast forward to 1832.  Congress approved the Act of June 7, 1832, which extended pension benefits to those who had served during the Revolutionary War.  The terms provided that officers and enlisted men who served two or more years would get full pay for life; men who served less than two years but at least 6 months were granted pensions of less than full pay.  Benefits were payable regardless of financial need or disability; furthermore, widows and children could collect unpaid benefits. 

William contacted the local pension agent, Charles Gibbs, who told him he did not qualify since he had not served six consecutive months.  So William gave up the idea of applying for a pension. Unfortunately Mr. Gibbs misunderstood the law; it actually did not require that service be continuous.

Twelve years later, the pension agent Coleman Payne in Greene County, where William was then residing, informed William that yes, indeed, his claim for a pension was good.  Payne set himself up as William’s representative to receive payments in his name and then pass the money on to William.

Trust the man in charge – that’s what many people do.  And that’s what William did.  Whether paying Payne HALF the allotted amount was William’s idea of fairness or Payne’s fee is not recorded in the pension file.  But William discovered the deal was not a good one.

Payne claimed he had drawn $240 for William who then gave him half, thus leaving William with $120 for service to his country.  William did not know until he heard from the state pension agent in Richmond that Payne had actually drawn $420, the full amount William was owed at $30 per year for the previous fourteen years.  In June 1845, William got himself a lawyer and registered a complaint against Coleman Payne. 

Justice did not come quickly if it came at all.  In January 1847, William appointed Thomas S. Thornton to be his agent to do two things:  collect the pension due him and to get his pension certificate back from Coleman Payne who was withholding it illegally.  When Thornton confronted Payne, Payne claimed he had no papers for Herndon because his claim had been rejected. 

It is not clear whether William Herndon actually received the pension due him.  He died seven months later.

52 Ancestors: #43 - Edward HERNDON

My 5X great-grandfather Edward Herndon (1738-1831) was the son of William HERNDON and Ann DRYSDALE.  In 1762 he married Mary Ann GAINES and together they raised at least twelve children in Culpeper County, Virginia.

Doing the math suggests Edward was just the right age to take up arms along with the militia against the British in the fight for independence in 1776.  Clearly Edward must have been a patriot.  But how much of a patriot was he?  The answer to that question might depend on whom you trust:  the DAR, the SAR, or Findagrave.com.

Findagrave shows a tombstone for one Edward Herndon buried in Elbert County, Georgia.  Engraved on the stone are his dates:  1768-1827.  A patriot marker rests at the base of the stone.   Another mathematical calculation reveals that THIS Edward was only 7 when the war began and 15 at its conclusion.  So it’s entirely possible that Edward had served briefly; however, THIS Edward was not the same Edward whose service records were presented as evidence for any descendants’ entry into the DAR or SAR.  In fact, THIS Edward was one of the sons of my 5X great-grandfather Edward Herndon.

Edward’s descendants are aided in their quest to prove their lineage by his will which named all twelve children.  It was dated 1822 and then probated in Madison County, Virginia in 1838, seven years following his death.  Ancestry.com has quite a few images of applications for membership into the Sons of the American Revolution (SAR), all of which seem to lead logically to this Edward; however, proof of Edward’s service has been verified by documents for a different Edward Herndon.

Sons-in-law were to have no rights to his estate.

Fold3 has documents that point to three Edward Herndons, none of which are MY 5X great-grandfather, let alone the ancestor of any of the SAR applicants.  In one case, Reuben Herndon of Kentucky, administrator for the estate of his grandfather Edward Herndon, petitioned for Edward’s pension allowance for the grandchildren.  This Edward, who died in Spotsylvania County, Virginia in November 1837, had only two children, however.  Not MY Edward, the patriot.

The other Edward was a resident of Campbell County although at the time of the Revolutionary War, he resided in Goochland, not far from Culpeper or Madison.  In 1844 he petitioned on his own behalf for the full pay owed him as an officer who had served the duration of the war.  In his application he provided amazing detail of service with corroborating evidence from soldiers who served with him.  Stories of his rise through the ranks and his capture by the British are echoed in numerous applications for membership in the SAR.  But this is not MY Edward Herndon.  How do I know?  Because this one said he left NO wife and NO children.   Yet application after application presents the lineage that can be traced only to my Edward.

On the DAR website the patriot lines look most like mine.  However, even MY Edward’s line has been flagged.  That means a problem has been found in at least one previously verified paper.  If I’m reading the site correctly, it appears someone may have assigned a descendant to the wrong parents.  That doesn’t mean Edward wasn’t a patriot.  According to the DAR, he served in the Culpeper Militia and supplied beef to the Army.  More specific evidence of his service is not available online. 

Fortunately Edward’s son William served too, and his record seems to have stayed out of the melee.

52 Ancestors: #33 - John Frank RUCKER

For many years the Rucker Society has argued over whether my 3X great-grandfather John Frank RUCKER was the son of Jarvis or Angus.  Traditional wisdom favored Jarvis.  However, common sense and the DAR won out and gave the prize to Angus. 

John Frank was the fifth of six children born to Angus and Jane Allen Rucker.  Unfortunately, his name never appears in a census record, to my knowledge.  Born about 1794, John Frank was likely the 16-25 year old male living in his parents’ home in Madison County, Virginia in 1810.  In 1820, he might have been in the household of his bride’s family, the Jarrells. 

Or perhaps he missed the census that year because he was off defending the country during and following the War of 1812.  There is a service record for John F.

as well as a record of enlistment in Madison County. 

John F. Rucker enlisted under Captain Mann P. Lomax.  John Frank was 26; he had brown hair,
hazel eyes, and dark complexion.  He was a farmer from Madison County.

John Frank enlisted in 1819 and was discharged in 1821.  Inspection Returns indicate he served
at Fort Monroe (Hampton, VA) and Fort Norfolk (Norfolk, VA).


How interesting to learn that John Frank had hazel eyes and served at Fort Norfolk, just a short drive through the tunnel from where I grew up. 

In 1830, he and his wife Mary were probably the 30-39 year old male and female living with Angus in Madison.

John Frank, Mary, and the kids must have moved to Rockingham County soon after.  John Frank died in Rockingham about 1839, as proven by the Abstracts of Guardian Bonds: 

"15 July 1839, Guardian Bonds, Rockingham Co., Va., 
Parent, John F. Rucker; Orphans, Onslow, Angeline, 
and Eliza; Guardian Jared Powell, Bond was $2,000, 
bondsmen, John Cook and Honorias Powell."

Two children were not mentioned, probably because they were already married and on their own.  One was Sarah Jane, and the other was Franklin Rucker, my great-great grandfather.

Sadly, where John Frank is buried is unknown, although it is probable that he lies in the Baugher Cemetery in Beldor, Rockingham County, Virginia, along with his wife Mary Jarrell Rucker.
